Burton Photography reserves the right to use images created under this contract for advertising, display, publication, competition, or other purposes. The Client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend Burton Photography in the event of litigation arising out of such use. Negatives, digital files, and previews remain the exclusive property of Burton Photography.

This contract constitutes an entire understanding between the parties. Any exception or modification shall be between written consent of both parties. It is agreed that an arbitration board through mediation will settle any disputes that arise out of this agreement between the photographers and clients. The board being a chosen council by an appointed judge of Watauga County, North Carolina with all litigation in Watauga County, North Carolina.
